1. Public Comment for Items not on Agenda. During this comment period, any person is invited to speak on any topic that is not listed on this agenda. Action may not be taken on any matter raised during this public comment period until the matter is specifically listed on a future agenda. Those who wish to comment on an item that has been listed on this agenda may comment when that item has been opened for consideration by the Commission and before any action is taken.

The Commission should avoid discussing and may not act on any matter raised during this public comment period, except to decide whether to place the matter on the agenda of a future meeting during the last item on the agenda.

3. In the Matter of Lucia Gutierrez. FPPC No. 21/024. Staff: Alex Rose, Senior Commission Counsel and George Aradi, Special Investigator. Lucia Gutierrez is a former member of the Newark Unified School District Board of Education. Gutierrez violated the Act by negotiating, participating in, and ultimately making an employment contract between the District and herself, in violation of Government Code Section 1090 (1 count). Total Proposed Penalty: $4,500.

4. Adoption of Proposed Regulation 18720; Annual Statements of Economic Interests; 2025 Filing Date Extension. Staff: Simon Russell, Commission Counsel. Staff presents proposed Regulation 18720 for adoption, providing an extension of the 2024 annual Statement of Economic Interests filing deadline (currently scheduled for April 1, 2025) to June 2, 2025, for filers impacted by the recent wildfires in Los Angeles County.

5. Adoption of Proposed Repeal and Amendment of Levine Act (Section 84308) Regulations and Related Regulations (Amend 18360.1, 18438, 18438.2, 18438.4-18438.8, 18705; Repeal 18438.3). 
Staff: Toren Lewis, Commission Counsel, Legal Division; Kevin Cornwall, Senior Commission Counsel, Legal Division. Staff presents proposed amendments to Regulations 18360.1, 18438, 18438.2, 18438.4-18438.8, and 18705, as well as the proposed repeal of Regulation 18438.3. These changes are proposed in response to recent Levine Act legislation (SB 1243 and SB 1181), and to clarify and clean up the Commission’s related regulations. The proposed amendments are presented for adoption, with pre-notice discussion having occurred at the January Commission meeting.

6. Regulation Projects and Schedule for 2025.
Staff: Dave Bainbridge, General Counsel. Staff proposes for Commission consideration a list of regulation projects for 2025 and a schedule for presenting these regulation projects to the Commission.
