1. Public Comment for Items not on Agenda. During this comment period, any person is invited to speak on any topic that is not listed on this agenda. Action may not be taken on any matter raised during this public comment period until the matter is specifically listed on a future agenda. Those who wish to comment on an item that has been listed on this agenda may comment when that item has been opened for consideration by the Commission and before any action is taken.

The Commission should avoid discussing and may not act on any matter raised during this public comment period, except to decide whether to place the matter on the agenda of a future meeting during the last item on the agenda.

Campaign Late Filer

3. In the Matter of New Car Dealers Association Issues PAC and Thomas Hiltachk; FPPC No. 22/928. Staff: Bridgette Castillo, Senior Commission Counsel. Respondents were represented by Ashlee N. Titus of Bell, McAndrews & Hiltachk, LLP. This matter arose from an audit performed by the Franchise Tax Board’s Political Reform Audit Program. New Car Dealer’s Association Issues PAC is a state general purpose committee that became a state primarily formed ballot measure committee at the end of September 2020. Thomas Hiltachk served as the Committee’s treasurer. The Committee and Hiltachk failed to file an amended Statement of Organization to re-designate the Committee to a primarily formed committee and properly amend the name of the Committee, in violation of Government Code Sections 84103 and 84107 (1 count). Total Proposed Penalty: $2,000.

4. Pre-Notice Default

4. In the Matter of South Bay SV Community Coalition PAC and Anthony Phan; FPPC No. 19/385. Staff: Bridgette Castillo, Senior Commission Counsel and Roone Petersen, Special Investigator. South Bay SV Community Coalition PAC was a general purpose candidate-controlled committee that made independent expenditures during the November 6, 2018 General Election. Anthony Phan served as the Committee’s principal officer and was a member of the Milpitas City Council. The Committee and Phan failed to timely file a qualifying Statement of Organization and identify Phan as the controlling candidate in the name of the Committee, in violation of Government Code Sections 84101 and 84201 (1 count), timely file eight 24-Hour Reports, in violation of Government Code Sections 84204 (4 counts) and 84203 (4 counts), timely file a pre-election campaign statement, in violation of Government Code Section 84200.5 (1 count); accurately disclose the source of a contribution, in violation of Governmental Code Section 84211 (1 count), timely file a semi-annual campaign statement, in violation of 84200 (1 count); timely file an Independent Expenditure Verification, in violation of Government Code Section 84213 (1 count), and include the proper advertisement disclosures in mailers, in violation of Government Code Section 84502 (5 counts). Total Proposed Penalty: $56,500.

5. Prenotice Discussion of Proposed Amendments to Regulation 18361.4 – Probable Cause Proceedings. Staff: John Feser, Senior Commission Counsel. Staff proposes several changes to the regulation governing probable cause proceedings to promote compliance with, and enforcement of, the Act. This regulation is presented for discussion and direction by the Commission and will be presented for adoption at a subsequent meeting.

6. Adoption of Proposed Amendments to Regulation 18404, Termination of Filing Requirements, Repeal and Adoption of Regulation 18404.1, Terminating Section 82013(a) Committees, and Adoption of Regulation 18404.3, Reopening a Terminated Section 82013(a) Committee. Staff: Karen Harrison, Senior Commission Counsel. Staff proposes the amendments, revised regulation, and new regulation to address new CARS requirements, recent changes to the law regarding the use of campaign funds for security expenses, and to update the reopening procedures. The proposed regulations are presented for adoption by the Commission.

7. The FPPC Streamline Program: How It Works (Part 2). Staff: Theresa Gilbertson, Senior Commission Counsel, Enforcement Division and Jonathan Rivera, Commission Counsel, Enforcement Division. Eligibility factors for campaign-related violations in the FPPC’s Streamline Program, including information on the violation types, notable criteria, and hypotheticals.

 

8. Legislative Update. Staff: Lindsey Nakano, Senior FPPC Legislative Counsel. The Commission will review and discuss potential sponsored and other legislation. The Commission may provide direction to staff regarding the same.
